METHUEN — Zoning Board denies early return request, approves two residential variances. The Board voted 3-2 to reject Dana Kilroy's request to challenge a prior unfavorable decision without waiting the standard two years, despite attorney Arthur Broadhurst's argument that a revised two-story building with one residential unit and office space was substantially different from the rejected three-family plan. In new business, the Board unanimously approved Brian Zepkoski's variance for a 23-by-16-foot addition and deck at 2 Hayes Street with setbacks of 3.1 feet on the right side and 27.7 feet on the rear, both below the required 30 feet.
The Board also unanimously approved Nicholas Marion's variance for a 19.4-foot front setback versus the required 20 feet at 14 Derry Road, necessitated by a discovery that the town owns five feet beyond the pavement as a utility easement.
